{"id":17133,"date":"2024-06-18T15:24:40","date_gmt":"2024-06-18T13:24:40","guid":{"rendered":"https:\/\/soema.it\/whistleblowing\/"},"modified":"2024-07-31T10:23:17","modified_gmt":"2024-07-31T08:23:17","slug":"whistleblowing-report-management","status":"publish","type":"page","link":"https:\/\/soema.it\/en\/whistleblowing-report-management\/","title":{"rendered":"Report Management"},"content":{"rendered":"<p>We ensure the receipt, management, analysis and processing of reports, including anonymous ones, in compliance with the provisions of Directive (EU) 2019\/1937 and its implementing law, Legislative Decree 24\/2023.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Definition<\/strong><\/p>\n<p>CThe expression \u201cWhistleblower\u201d refers to the person who reports violations, irregularities or wrongdoing committed to the detriment of the public and corporate interest to the bodies entitled to intervene.<\/p>\n<p>Specifically, the violations that can be reported under Legislative Decree 24\/2023, the so-called \u201cWhistleblowing Decree\u201d must relate to behaviors, acts or omissions that are detrimental to the integrity of the company, of which the Whistleblower has become aware in the work context, pursuant to art. 3, co. 2, lett. a), namely:<\/p>\n<ul>\n<li>violations of EU law (e.g., transport safety; environmental protection; consumer protection; privacy and personal data protection and security of networks and information systems; etc&#8230;..).<\/li>\n<\/ul>\n<p>Whistleblowing, in this view, is an act of manifestation of civic sense, through which the Whistleblower contributes to the emergence and prevention of prejudicial risks and situations.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Purpose<\/strong><\/p>\n<p>The main purpose of Whistleblowing is to prevent or solve a problem internally and in a timely manner.<\/p>\n<p>Confidentiality about the subjects and facts reported, as well as the identity of the whistleblowers, is guaranteed so that the whistleblower is not subject to any form of retaliation.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Modalities<\/strong><\/p>\n<p>Reports can be sent through a special Platform &#8211; suitable for guaranteeing, by computer methods, the confidentiality of the identity of the reporter &#8211; available at the following link:<\/p>\n<p><a href=\"https:\/\/studiolegalemcg.trusty.report\/\" target=\"_blank\" rel=\"noopener\"><strong><span class=\"underline\">SEND REPORT<\/span><\/strong><\/a><\/p>\n<p>This channel is considered preferential and suitable to ensure, by means of information technology, the confidentiality of the reporter&#8217;s identity.<\/p>\n<p>Reports will be handled by the MCG Law Firm, which provides staff and professionals with autonomy and specifically trained in handling reports.<\/p>\n<p>Please note that, alternatively, reports can also be sent through the following channels:<\/p>\n<ul>\n<li>By telephoning +39.071.2210265<\/li>\n<li>By sending reports or requesting an appointment at the company&#8217;s headquarters in Corso Garibaldi 43, Ancona (AN)<\/li>\n<\/ul>\n<p>Without prejudice to the preferential use of the reporting channels made available, in the cases strictly indicated pursuant to Article 6 of Legislative Decree 24 of March 10, 2023, it is also possible to make reports to the relevant authority (ANAC).<\/p>\n<p>For more information, including what you can report, please read the Whistleblowing Procedure:<\/p>\n<p><a href=\"https:\/\/soema.it\/wp-content\/uploads\/2024\/06\/PROCEDURA-WHISTLEBLOWING_Rev.-1.pdf\" target=\"_blank\" rel=\"noopener\"><strong><span class=\"underline\">Whistleblowing Procedure<\/span><\/strong><\/a><\/p>\n<p>Information and personal data disclosed in the context of whistleblowing reports are processed for the purpose of managing and following up on the reports, as well as investigating any reported conduct and taking necessary measures in accordance with applicable laws, including data protection regulations.
